BackConnect, Inc. (“Website”, “we”, “us”, “our”, or “BackConnect”) Privacy Policy (“Policy”) outlines the general policy and practices regarding the use and disclosure for the types of information collected via BackConnect website, the BackConnect mobile application, services, downloadable software, and any other websites and mobile services that link to this privacy policy (the “Service”), how we use that information, and the options that our users (“you” or “your”) have regarding our use of, and your ability to correct, such information. Your use of BackConnect and any personal information you provide through the Service remains subject to the terms of this Privacy Policy and our Terms (“backconnect.com/terms”). BackConnect’s website and services are not intended for, nor designed to attract, individuals under the age of eighteen. BackConnect does not knowingly collect personally identifiable information from any person under the age of eighteen.

BackConnect will not rent, share, sell, or give away any of your personal information without your consent. In order for us to provide some of our services we may need to provide information that you supply to us, to external parties. When such sharing is necessary, we will provide you with explicit notice, and whenever possible, the ability to opt-out of such service.

Scope

This Privacy Policy applies to all visitors to our website, users of our services, and information we collect from visitors to the websites of users of our services. The Website contains many references or links to other websites which are owned and operated by third parties. These third party websites are not covered by this Privacy Policy. We accept no responsibility or liability in respect of these third party websites. We therefore encourage you to review and understand the privacy policies published on any third websites you may access through the Website before using or submitting any information to them.

Information Collection

BackConnect is the owner of the information collected on the website and through its services. BackConnect normally logs visitors of our website as well as our users’ websites if they are protected by our services, in order to provide better services to our users.

Billing Information

BackConnect collects and maintains certain information from our users for the purposes of billing. We may report this information to third party processors for the limited purpose of receiving payment. We do not store full credit card numbers or personal account numbers.

Cookies

BackConnect uses “cookies” in order to provide a better service to you. Cookies may be placed by your browser on your computer’s hard drive to assign a unique identification to that computer. For example, we may use cookies to help direct you to the appropriate part of our website, by indicating that you are a repeat visitor to our website. We also may use that information to present you with services that are customized to your preferences. BackConnect does not store information we consider personal or private in a cookie, unless that information is obscured. You may at any time delete BackConnect’s cookies yourself through your browser’s cookie manager. However, removing cookies may disable auto-login, reset your session, and adversely affect other functions on the BackConnect’s website and services provided to you. BackConnect may also place cookies on your visitors that visit your BackConnect protected service for the reason of identifying malicious visitors and to reduce the chance of blocking legitimate users and to provide customized services.

Data Aggregation

BackConnect may use the data we acquire about our users and the visitors to their websites to aggregate data. In the event that we share this information to external parties, our users’ personal information will never be attached to or included in such aggregated data. Data that our users provide to us, such as log files of their site’s visitors, may be included in the aggregate data, reports, and statistics.

Third Party Apps and Promotional Partners

Business and promotional partners of BackConnect will not have any access to information used to target users, including the names of the people who may be interested in a particular product or service. In the event we share information to you in regards to a promotion, we will not forward that information to a partner without your consent. If you use a 3rd party app, BackConnect may provide your email address to that partner for account creation and communication with that partner. In all cases, these partners may have their own privacy policies and partners are not covered by this Policy. We encourage you to read such privacy policies.

Third Party Websites

BackConnect is not responsible for the privacy practices of external websites that we may link on our website or services. We encourage you to be aware of when leaving our website and to read the privacy statements of any external website and/or service.

Law Enforcement

BackConnect may be required by a court order to provide information about our customers to third parties. We may also be required to provide information pursuant to law, applicable regulation, subpoena, or other legal processes. It is our corporate policy to ensure adherence to the due process of law in all such legal requests. If we are required to provide information under these circumstances, we will, whenever possible, attempt to inform our users whose information we are compelled to produce.

Information Security, Access, and Integrity

BackConnect takes all reasonable steps to make sure our users’ information is protected from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. We have put in place physical, electronic and managerial procedures to safeguard and secure such information. BackConnect only uses personal information in a way that is compatible with and relevant for the purpose for which it was collected or authorized by the individual. Users and visitors may access their own personal information and correct, amend, or delete inaccurate personal information, except where the burden or expense of providing such access would be disproportionate to the risks to the privacy of the individual, or where the rights of persons other than the individual risk being violated. BackConnect may choose the right to outsource certain business functions to third party vendors, including website and marketing analytics. When we do, notwithstanding the foregoing, we will ensure that such vendors are bound by appropriate confidentiality restrictions to protect the information covered by this Policy.

Registrar Services

Users that purchase BackConnect’s registrar services, ICANN and the registry operators overseeing a domain’s TLD require us to publish registrant data via the “WHOIS” protocol. We may also be required to share this public data with ICANN, registry operators, and other such bodies. Registrant data includes domain name, domain name server information, registrant name, and contact information.

EU-U.S. Data Transfers

By using BackConnect’s website and services, you consent to the transmittal of personal data outside of the European Union, if applicable, and understand that such transmittal may be required for performance of your agreement(s) with BackConnect. This applies to information in electronic verbal format, or paper. BackConnect participates in the U.S-EU Safe Harbor framework. We agree to TRUSTe dispute resolution for disputes relating to our compliance with this Safe Harbor framework. Complaints regarding our compliance should be directed to BackConnect at abuse@backconnect.com. If contacting us does not resolve this dispute, users may send a complaint with TRUSTe by internet at www.truste.com, by fax at 415-520-3420, or by mailing the TRUSTe Safe Harbor Compliance Department. Complaints must include the following information: company name, the alleged privacy violation, the user’s contact information, and whether the particulars of the complaint should be shared with the company. The TRUSTe dispute resolution process shall be conducted in English.
